Employee sues Earnhardt Ganassi over testing tunnel Jesus Hernandez, a former NASCAR diversity driver, is suing Earnhardt Ganassi Racing, claiming in his lawsuit that he was fired from his job as a test team mechanic after questioning whether a EGR testing tunnel had proper ventilation. Hernandez filed the lawsuit after his claim was rejected by the North Carolina Department of Labor, which cited that there was not enough evidence for it to prosecute a violation under the law. Hernandez went to the tunnel three times in 2009, his suit says. He claims in court documents that he suffered symptoms consistent with carbon monoxide poisoning. Scene Daily
