Judge mocks NASCAR and Mayfield

U.S. District Court Judge Graham Mullen either is not happy with the attorneys for NASCAR and suspended driver Jeremy Mayfield or he has a sense of humor. Or maybe a little bit of both.

The judge has scheduled a Jan. 7 hearing over a variety of issues in the case. He scheduled the hearing on Wednesday, a day after NASCAR filed a sealed motion to compel, an action that implies it is not getting all the information it wants from Mayfield’s side.

In his order setting the Jan. 7 hearing, the judge wrote: “The parties, exhibiting a need for adult supervision, are ordered to appear for a status/discovery scheduling conference on January 7."

Mayfield filed a lawsuit following his suspension for a May 1 drug test that NASCAR says produced a positive result for methamphetamines. Mayfield denies using methamphetamines, claiming the test results were produced by a combination of prescription medicine for attention-deficit hyperactivity disorder and over-the-counter allergy medication.

He is suing NASCAR and drug-testing laboratory Aegis Sciences Corp. for breach of contract, negligence, defamation, discrimination and unfair and deceptive trade practices. Scenedaily.com
