Mediation fails to settle Ward family’s lawsuit against Tony Stewart (Update)

UPDATE Tony Stewart and the parents of Kevin Ward Jr. were in Syracuse Federal Court on Friday for a scheduled conference over the Ward family's wrongful death lawsuit.

It is unclear if an agreement was reached.

Ward's parents say Stewart was reckless and intentionally hit the gas in an attempt to intimidate their son before the 20-year-old was struck and killed at the Canandaigua Motorsports Park nearly three years ago.

Stewart says he did not see Ward on the track and is trying to have the case dismissed.

An eight-hour mediation session last week did not lead to a settlement of the lawsuit the family of Kevin Ward Jr. filed against Tony Stewart, a court document shows.

It was the second eight-hour mediation session. The first was held April 18.

With no settlement, the suit will continue as scheduled. A motion on Stewart’s behalf for partial summary judgment will be heard June 23 at U.S. District Court in Utica, New York. Mediation report
